When dealing with a Foreign National living in the United States, anything you discuss with them or give to them is bound by US Export Regulations. A Foreign National in the US is no different than dealing with a Foreign National that you are visiting in their country. That is why I asked the question the way I did.

According to the Immigration and Naturalization Act (INA), anyone who is not a US Citizen is a Foreign National.
